Terms of Service and Disclaimer for the SamariAID Mobile Application These terms and conditions ("Agreement") set forth the general terms and conditions of your use of the "SamariAID" mobile application ("Mobile Application" or "Service") and any of its related products and services (collectively, "Services"). This Agreement is legally binding between you ("User," "you," or "your") and SamariAID ("SamariAID," "we," "us," or "our"). If you are entering into this agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this agreement, in which case the terms "User," "you," or "your" shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this agreement, you must not accept this agreement and may not access and use the Mobile Application and Services. By accessing and using the Mobile Application and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. You acknowledge that this Agreement is a contract between you and SamariAID, even though it is electronic and is not physically signed by you, and it governs your use of the Mobile Application and Services. YOU SHOULD NEVER DISREGARD A DOCTOR’S PROFESSIONAL ADVICE OR CANCEL AN APPOINTMENT WITH A DOCTOR BECAUSE YOU ARE RELYING ON INFORMATION YOU HAVE READ OR HEARD IN THE SAMARIAID PLATFORM. 1. User Content We do not claim ownership of any data, information, or material (collectively, "Content") that you submit in the Mobile Application while using the Service. You retain sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use all submitted Content. While we may monitor and review the Content in the Mobile Application created using our Services, we have no obligation to do so. By using our Services, you grant us permission to access, copy, distribute, store, transmit, reformat, display, and perform the Content of your user account solely for the purpose of providing the Services to you. We reserve the right, though not the obligation, to refuse or remove any Content that violates our policies or is deemed harmful or objectionable in our reasonable opinion. Additionally, you grant us a license to use, reproduce, adapt, modify, publish, or distribute the Content created by you or stored in your user account for commercial, marketing, or similar purposes. This license is valid for the duration of your use of the Mobile Application and Services. 2. Backups We are not responsible for the Content residing in the Mobile Application. We shall not be held liable for any loss of Content. You are solely responsible for maintaining appropriate backups of your Content. While we may, on some occasions and in certain circumstances, restore some or all of your deleted data from our backups, we make no guarantee of data availability . 3. Links to Other Resources The Mobile Application and Services may provide links to other resources, such as websites or mobile applications. However, we do not imply any approval, association, sponsorship, endorsement, or affiliation with any linked resource unless specifically stated herein. We are not responsible for examining or evaluating the offerings, actions, products, services, or content of any other third parties. You should review the legal statements and conditions of use of any resource accessed through a link in the Mobile Application. Your linking to any off-site resources is at your own risk. 4. Intellectual Property Rights "Intellectual Property Rights" means all present and future rights conferred by statute, common law, or equity in relation to copyright and related rights, trademarks, designs, patents, inventions, goodwill, and the right to sue for passing off, rights to inventions, rights to use, and all other intellectual property rights, registered or unregistered. This Agreement does not transfer any intellectual property rights owned by SamariAID or third parties to you. All trademarks, service marks, graphics, and logos used in connection with the Mobile Application and Services are the property of SamariAID or its licensors. Other trademarks, service marks, graphics, and logos used in the Mobile Application and Services may belong to third parties. Your use of the Mobile Application and Services does not grant you any right or license to reproduce or otherwise use any of SamariAID's or third-party trademarks. 5. Limitation of Liability To the fullest extent permitted by applicable law, SamariAID, its affiliates, directors, officers, employees, agents, suppliers, or licensors shall not be liable to any person for any indirect, incidental, special, punitive, cover, or consequential damages arising from the use of the Services (including but not limited to lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity), whether based on contract, tort, warranty, breach of statutory duty, negligence, or otherwise. SamariAID's aggregate liability and that of its affiliates, officers, employees, agents, suppliers, and licensors, relating to the Services, will be limited to an amount no greater than one dollar or the total amount actually paid in cash by you to SamariAID during the one-month period preceding the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain types of damages, so the above limitations may not apply to you to the extent prohibited by law. 6. Severability All rights and restrictions contained in this Agreement are intended to be limited to the extent necessary to comply with applicable laws and to prevent this Agreement from being rendered illegal, invalid, or unenforceable. If any provision or portion of any provision of this Agreement is held to be illegal, invalid, or unenforceable by a court of competent jurisdiction, the remaining provisions or portions thereof shall constitute the agreement between the parties regarding the subject matter hereof, and all such remaining provisions or portions shall remain in full force and effect. 7. Changes and Amendments We reserve the right to modify this Agreement or its terms relating to the Mobile Application and Services at any time, effective upon posting an updated version of this Agreement in the Mobile Application. Continued use of the Mobile Application and Services after any such changes shall constitute your consent to such changes. 8. Acceptance of These Terms By accessing and using the Mobile Application and Services, you acknowledge that you have read this Agreement and agree to all its terms and conditions. If you do not agree to abide by the terms of this Agreement, you are not authorized to access or use the Mobile Application and Services. 9. As a result, it has certain limitations and should not be relied upon as a substitute for professional medical advice or treatment. The information provided by the application is based on recognized medical literature and guidelines but may not cover all possible scenarios or circumstances. The SamariAID mobile application is designed to recognize, classify, and provide recommendations to stabilize the following 13 types of wounds: 1. Abdominal Wounds, 2. Burns, 3. Epidermolysis Bulls, 4. Extravasation, 5. Foot Ulcers, 6. Hemangioma, 7. Leg Ulcer, 8. Malignant Wounds, 9. Meningitis, 10. Orthopedic Wounds, 11. Pilonidal Sinus, 12. Pressure Ulcer, 13. Toe Wounds. It is important to note that the application's recommendations are general in nature and may not be suitable for every individual or situation. The SamariAID mobile application does not own any data, information, or material ("Content") submitted by users. Users are solely responsible for the accuracy, quality, integrity, legality, reliability, appropriateness, and ownership of all submitted Content. While we may monitor and review user-submitted Content, we are not obligated to do so. We reserve the right, in our sole discretion, to refuse or remove any Content that violates our policies or is deemed harmful or objectionable. We are not responsible for any loss of Content stored in the Mobile Application. It is your sole responsibility to maintain appropriate backups of your Content. While we may, in certain circumstances, restore deleted data from our own backups, we make no guarantee that the data you need will be available. The Mobile Application and Services may contain links to other resources, such as websites or mobile applications. We do not endorse or assume any responsibility for the content, products, services, or actions of any third-party resources linked to from the Mobile Application. Your use of such resources is at your own risk.
